What Information Do We Collect?
The information we learn from customers helps us personalize and continually enhance the Site and the services we offer. We gather the following types of information:
Automatic Information. We automatically receive and store from the Site certain types of information whenever you interact with us. For example, as most websites do, we use "cookies" and other technologies to obtain certain types of information when your computer, mobile phone or other device (each, a “Device”) accesses the Site. This information is compiled and analyzed on both a personal and an aggregated basis, and it may include the Website's Uniform Resource Locator (“URL”) that you just came from, which URL you go to next, what browser you are using, and your Internet Protocol (“IP”) address. Other examples of automatic information we may collect are purchase history, products viewed or searched for, visits to certain pages, page interaction information and the phone number you used to call any of our toll-free customer service numbers. We associate the information we store in cookies with PII you submit while on the Site. During some visits, we may also collect technical information from your Device to help us identify your Device for fraud prevention purposes.
Mobile Devices. If you use a mobile Device to access the Site, we may collect certain information in addition to what we collect when you use other kinds of Devices to access the Site. We may receive information about your location and your mobile Device, including a unique identifier for your Device, your mobile operating system, and the type of mobile Internet browser that you use. We may at times use this information to provide you with location-based services and information, such as advertising, search results, and other personalized content. Most mobile Devices provide users with the ability to disable location services. If you have questions about how to disable your Device's location services, we recommend you contact your mobile service carrier or your Device manufacturer.
Information Provided by Third Parties. We may obtain certain information about customers from third parties. This may include updated delivery or address information from carriers.
Cookies. We use small text files called “cookies” that provide non-personally identifiable information to us regarding visitors to the Site. In addition to the URL and IP addresses of our visitors detailed above, cookies may be used to gather the date and time of all visits to the Site. We may also track the pages of the Site which users viewed during their visit, or track search terms entered on the Site by that visitor. This helps us keep track of the number of visitors to the Site and allows us to gauge the areas that are of the most interest to our visitors.
We also use Local Shared Objects (commonly known as Flash cookies) for fraud prevention and other purposes. Flash cookies are small data files that a website or App Sites on your Device. These files may contain information about your online browsing activities and preferences.
How Do We Use the Information We Collect and Do We Share the Information We Receive?
Information about our customers is an important part of our business. We use information we collect from the Site to communicate with you, to process your orders, to authenticate your identity, to provide an enhanced and more personalized interactive shopping experience, to facilitate your transactions with our third party marketing partners, if any, and to inform you of offers and discounts. For example, we may communicate with you in response to your inquiries, to provide the services you request and to manage your account. We also send service-related announcements on occasions such as when we need to temporarily suspend the Site, the app or other service for maintenance. We also will send you promotional e-mails on occasion. Generally, you may not opt out of service-related communications, which are not promotional in nature. You can opt-out of receiving direct promotional communications from the Site by contacting us with the request. See the “Contact Us” section of this policy for information.
What Information is Collected Through Integration With Third Party Services?
Third-Party Service Providers. We employ other companies to perform functions on our behalf. Examples include fulfilling orders, delivering packages, sending postal mail or e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and link (including paid listings and links), processing credit card payments, and providing customer service. They have access to PII to the extent they need to perform their functions, but may not use it for other purposes.
Social Networking Sites. Where integration with a social networking site is present on the Site, it is provided to enhance the Recyclebank member experience. When you add any social networking service to your Recyclebank online profile and access the Site through your other social networking account(s), Recyclebank will collect relevant information necessary to enable this Site to access and collect your data contained within that particular social networking service (e.g. such as your Facebook profile information). Please remember however that the manner in which such third party social network provider uses, stores and discloses your information is governed solely by that provider’s policies, and Recyclebank will have no liability or responsibility for the privacy practices or other actions of any third party site or provider that you may enable and link to your online experience with Recyclebank.
We periodically provide our customers with information about third party products and services we believe will be of interest to you and with opportunities to participate in offers and/or promotions on behalf of other businesses. Your participation in these events may require us to share data with such a business. If you do not want to receive such information or offers, on behalf of third parties or otherwise, please opt-out following a transaction, e-mail us later at firstname.lastname@example.org, or follow the unsubscribe instructions within each communication.
From time to time, we may establish a business relationship with third parties who we believe are trustworthy and who will be asked to confirm that their privacy policies and procedures are substantially consistent with ours. In such cases, these third parties will be known as our “Select Partners”. Where we have a Select Partner, we may share and cross-reference information, including PII about you, that will enable such persons or entities to contact you regarding products and services that may be of interest to you. We may also combine your PII with publicly available information and information we receive from or cross-reference with our Select Partners and others. We use that combined information to enhance and personalize your shopping experience with us, to communicate with you about our products and services that may be of interest to you and for further promotional purposes. If you do not want us to share information with Select Partners, please opt-out during registration, e-mail us later at email@example.com, or follow the unsubscribe instructions within each communication.
If you review a product on the Site, your review may be posted on the Site, as well as on a partners' network site that shares reviews with other shopping communities. When seeking or receiving customer testimonials or feedback, we disclose that we may post the customer’s first name along with all or a portion of his/her testimonial on the Site unless the customer inform us otherwise by following the instructions we provide.
In the event that the Site, all or substantially all of its respective assets is acquired, individually identifying information of our members may be one of the assets sold in connection with that transaction, without notice to you or your consent. In such an event, we will notify Site users of such a change in ownership or transfer of assets by posting a notice on the Site.
In the unlikely event of our bankruptcy, insolvency, reorganization, receivership or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your PII is treated, transferred or used. Therefore, you should know that in such event, your PII may be treated like any other asset of Recyclebank, and sold, transferred or shared with third parties, or used in ways not contemplated or permitted hereunder, without notice to you or your consent.
Protection of Recyclebank and Others.
How Secure Is the PII You Collect?
We have taken precautions, including the deployment of technological resources and the use of firewalls, systems and procedures, to protect the security of your PII. While no security system is absolutely foolproof, we are constantly reviewing, refining and upgrading our security technology to protect your privacy. If you are accessing the Site as a Recyclebank member, you are issued a password by which to access and secure your account and account information. Although we have taken these precautions, you are responsible for maintaining the secrecy of your password, which should not be disclosed by you. When using a shared Device, always be sure to sign off when finished. We do not store your credit/debit card numbers, expiration date or other billing information; we transmit the information only during order processing.
Third Party Links and Websites
You must be 18 years of age or older to transact with Recyclebank via One Twine. We do not knowingly collect information nor transact from minors.
Changing Your Personal Information
As a Recyclebank member transacting through the Site, you may review, change or correct your PII at any time by accessing your account information on www.recyclebank.com or calling us at the contact information below. You are responsible for maintaining the accuracy and completeness of your personal information, including your e-mail address, and we urge you to review your information regularly to ensure that it is correct and complete.

PRICES/FEES AND PAYMENTS.
You agree to pay all charges incurred in connection with your purchase (including any applicable taxes) at the rates in effect when submitting your order. We will bill all charges to the credit card you supply us.
ORDER CONFIRMATIONS, STATEMENTS, NOTICES AND OTHER COMMUNICATIONS.
You understand that it is your responsibility to review, upon first receipt, whether delivered to you by e-mail, by a posting on the Website, or by all other electronic means, all order confirmations, transaction history, notices and other communications. All information contained therein shall be binding upon you, if you do not object, either in writing or via electronic mail, within twenty-four (24) hours after any such document or information is sent to you or available on the Website. In all cases, One Twine reserves the right to determine the validity of your objection to the transaction. Such notices, information and other communications from One Twine shall be deemed to be delivered and available to you whether actually received or not.
You agree that Recyclebank fulfills its legal obligation to deliver to you any such document if sent via electronic delivery. Electronic delivery may be in the form of an e-mail, an electronic mail attachment, a posting on the Website, or in the form of an available download from the Website. You represent that you will download the relevant document promptly after receiving notice of its availability. Should you experience any difficulty opening a document electronically delivered by One Twine, you will promptly advise One Twine in order to allow us to make the required delivery by other means. Failure to advise One Twine of such difficulty within twenty-four (24) hours after delivery shall serve as an affirmation that you were able to receive and open said document.
LICENSE AND ACCESS
Subject to your compliance with these Terms and your payment of any applicable fees, Recyclebank or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of your Recyclebank account (if you are accessing the Site as a registered member) or alternatively as a user with One Twine. This license does not include any resale or commercial use of any One Twine content; collection and use of any product listings, descriptions or prices; any derivative use of One Twine or its content; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Terms are reserved and retained by Recyclebank or its licensors, suppliers, publishers, or other content providers. No part of One Twine may be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose without express written consent of Recyclebank. You may not frame or utilize framing techniques to enclose any trademark, logo or other proprietary information (including images, text, page layout or form) of One Twine without express written consent. You may not use any metatags or any other “hidden text” utilizing Recyclebank’s name or trademarks without the express written consent of Recyclebank. You may not misuse One Twine services. You may use One Twine only as permitted by law. The licenses granted by Recyclebank terminate immediately if you do not comply with these Terms or any other applicable document.
Recyclebank grants you a single, non-exclusive, limited personal license to access and use the Website conditioned on your continued compliance with the terms and conditions in these Terms. You may not transfer or share your right as a Recyclebank member to access or use the Website.
ACCESSING THE WEBSITE
With the exception of applications commonly known as Web Browser software, or other applications formally approved by Recyclebank in writing, you agree not to use any software, program, application or any other device to access or log on to Recyclebank's computer systems, Website or proprietary software or to automate the process of obtaining, downloading, transferring or transmitting any content, information or quotes to or from Recyclebank's computer systems, Website or proprietary software. Recyclebank is not responsible for, and makes no warranties regarding, the access, speed or availability of the Internet in general or the Website in particular.
You agree that you will not: (a) use any robot, spider, other automatic device or manual process to monitor or copy our web pages or the content contained herein without our prior written permission; (b) use any device, software or routine to interfere or attempt to interfere with the proper working of the Website or any transaction being conducted on either; (c) take any action that imposes an unreasonable or disproportionately large load on our infrastructure; or (d) reverse engineer, reverse assemble or otherwise attempt to discover any source code.
Much of the information on the Website is updated on a real time basis and is proprietary or may be licensed to us by others. You agree that you will not copy, reproduce, alter, modify, create derivative works, or publicly display any content from the Website without our prior written permission, or that of the appropriate third party. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Recyclebank and our affiliates without express written consent. You may not use the One Twine and/or Recyclebank name, trademarks, service marks, logos, designs, slogans or any other words or codes identifying One Twine or Recyclebank in any meta tags, "hidden text," information used by search engines or other information tools to identify and select sites without the express written consent of Recyclebank.
RESPONSIBILITIES & LIMITATION OF LIABILITY
In accordance with the Recyclebank Membership Agreement, you represent that you will be the sole and exclusive authorized user of your password associated with your Recyclebank account and you accept sole responsibility for use, confidentiality and protection of the password as well as for all orders and information changes (i.e., changes of address) entered into your account using such password. We reserve the right to refuse service, terminate accounts, remove or edit content or cancel orders in our sole discretion.
You accept full responsibility for the monitoring and safeguarding of your Recyclebank account. You will immediately notify Recyclebank in writing, delivered via e-mail and certified/return receipt requested U.S. mail, if you become aware of any loss, theft or unauthorized use of your password and account number; or any failure by you to receive a message from us indicating that an order via One Twine was received and executed or any inaccurate information in your account or transaction history. If you fail to notify Recyclebank immediately upon your knowledge when any of the conditions detailed herein occur, neither Recyclebank nor any of its officers, directors, employees, agents, affiliates or subsidiaries can or will have any responsibility or liability to you or to any other person whose claim may arise through you for any claims with respect to the handling, mishandling or loss of any order. Under no circumstances, including negligence, shall Recyclebank or anyone involved in creating, producing, delivering or managing Recyclebank's services be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the Website, the services provided by Recyclebank or out of any breach of any warranty by Recyclebank. This exclusion or limitation of liability will not apply to the extent that any applicable statute prohibits such exclusion or limitation of liability. To the extent that any applicable statute applies which modifies the above, Recyclebank's liability shall not include any hypothetical gains or losses, and it is agreed that the trier of fact shall only consider the actual facts, or lack thereof, of the parties to these Terms.
The use and storage of any information, including, without limitation, the password, transaction activity, or credit balances and any other information or orders available on your personal computer is at your own risk and is your sole responsibility. You are responsible for providing and maintaining the communications equipment (including personal computers and modems) and telephone or alternative services required for accessing and using the Websites or related services, and for all communications service fees and charges incurred by you in accessing the Websites or related services.
LIMITATIONS, RESTRICTIONS AND TERMINATION OF ONE TWINE SERVICES
You are authorized to use products or materials which are sold or made available by One Twine for your own needs only, and you are not authorized to resell products or access to any such materials or to make copies of any such materials for sale or use to and by others. You will not delete copyright or other intellectual property rights notices from printouts of electronically accessed materials.
You understand that Recyclebank may at any time, at our sole discretion and without prior notice to you, prohibit or restrict your access to the use of the Website or related services or your ability to purchase products on the Website. Recyclebank may terminate your account at any time for any reason and without prior notice to you. You are free to terminate your Recyclebank account at any time for any reason, subject to the conditions of the Recyclebank Membership Agreement. The closing of an account will not affect the rights and/or obligations of either party incurred prior to the date the account is closed.
MONITORING AND RECORDING TELEPHONE CONVERSATIONS AND E-MAIL
For your protection and for the protection of Recyclebank, and as a tool to correct misunderstandings, you understand, agree and authorize Recyclebank, at its discretion, and without further prior notice to you, to monitor and record any or all telephone conversations between you and Recyclebank and any of Recyclebank's employees or agents and to monitor your electronic communications with Recyclebank.
INFORMATION AND PRODUCT DESCRIPTIONS
The Website may make available certain data, news, research, statistics, stories, photographs and opinions or other information (collectively “Information”) that it has prepared itself or that has been independently obtained by other services and individuals, including news wires, statistics providers, journalists, authors and other providers (collectively the “Information Providers”). We do not guarantee or certify the accuracy, completeness, timeliness or correct sequencing of the Information made available through One Twine, the Information Providers or any other third party transmitting the Information (the “Information Transmitters”). You agree that neither Recyclebank, the Information Providers nor the Information Transmitters shall be liable in any way for the accuracy, completeness, timeliness or correct sequencing of the Information, or for any decision made or action taken by you relying upon the Information. You further agree that neither Recyclebank, the Information Providers nor the Information Transmitters will be liable in any way for the interruption of any data, Information or other aspect of the Website. You understand that none of the Information available through the Website constitutes a recommendation or solicitation to take or not take any particular action.
Further, Recyclebank does not warrant that product descriptions on the Website are accurate, complete, reliable, current or error-free. If a product offered by Recyclebank itself is not as described, your sole remedy is to return it promptly in unused condition.
Despite our best efforts, a small number of the items on One Twine may be mispriced. If we discover a mispricing, we will do one of the following:
If an item’s correct price is lower than our stated price, we will charge the lower amount and ship you the item.
If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.
RISK OF LOSS
All items purchased from One Twine are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
The merchandise offered for sale by One Twine is manufactured by third parties and to the full extent permissible by law. Recyclebank disclaims all representations and warranties therein. Recyclebank offers returns for all items within thirty (30) days of date of purchase. Returns should be initiated by contact our customer care department to receive a return authorization. Returned merchandise must be received in new condition with all original packing and accessories, if applicable. If you receive merchandise which is broken or damaged you must notice us within thirty (30) days as detailed herein. Problems or defects with such merchandise should be forwarded to the manufacturer of the merchandise.
The Website may permit you to post reviews, comments and other content; and submit suggestions, ideas, comments, questions or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, chain letters, mass mailings or any form of "spam." You may not use a false email address, impersonate any person or entity or otherwise mislead as to the origin of your content. Recyclebank reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content. If you do post content or submit material, and unless we indicate otherwise, such content and/or material will be considered non-confidential and non-proprietary and you grant Recyclebank and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such materials and/or content throughout the world in any media. You grant Recyclebank and its affiliates and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Recyclebank or its affiliates for all claims resulting from content you supply. Recyclebank has the right but not the obligation to monitor and edit or remove any activity or content. Recyclebank takes no responsibility and assumes no liability for any content posted by you or any third party.
Without limiting any of the foregoing, Recyclebank is free to use any ideas, concepts, know-how or techniques contained in any communication you send to Recyclebank for any purpose whatsoever, including, but not limited to, developing and marketing products using such information.
AMENDMENTS; ENTIRE AGREEMENT

YOU EXPRESSLY AGREE THAT YOUR USE OF THE WEBSITE IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, RECYCLEBANK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. RECYCLEBANK DOES NOT WARRANT THAT THE WEBSITE, ITS SERVERS, OR EMAIL SENT FROM THE WEBSITE OR RECYCLEBANK ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. RECYCLEBANK WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE WEBSITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.

The Website, its content and compilation of content, and all software used on the Website is owned by Recyclebank or its affiliates or agents and is protected by United States Copyright Act of 1976, as amended, and the copyright laws of other countries. All content, logos, designs and icons are proprietary to Recyclebank or its affiliates or agents. The materials provided in this service, including graphic images, buttons and text, may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way, without the prior written permission, except that you may download, display, or print one copy of the materials on a single computer solely for your personal, non-commercial, home use, provided that you keep intact all copyright, trademark and other proprietary notices. Modification of the materials or use of the materials for any other purpose is a violation of Recyclebank's, its affiliates' or its third party information providers' copyrights and other proprietary rights.
"One Twine", "Recyclebank" and other marks (including graphics, logos, page headers, button icons, scripts and service names) indicated on our Website are trademarks or trade dress of Recyclebank in the United States and other countries. Recyclebank's trademarks and trade dress may not be used in connection with any product or service that is not Recyclebank's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Recyclebank or the Website. All other trademarks not owned by Recyclebank that appear on this Website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Recyclebank.
MODIFICATIONS TO THE WEBSITE
Recyclebank reserves the right to modify or discontinue, temporarily or permanently, all or any portion of the Website with or without notice. You agree that Recyclebank will not be liable to you or to any third party for any such modification, suspension or discontinuance.
The license granted under these Terms will terminate if you fail to comply with any term or condition. Upon such violation, you agree to terminate access to the Website. You further agree that Recyclebank, in its sole discretion and with or without notice, may terminate your access to any or all of the Website, and remove and discard any information or content within the Website. You also agree that Recyclebank will not be liable to you or any third-party for any termination of your access to the Website.
If any part of these Terms is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.
Any dispute or claim relating in any way to your visit to the Website or to products or services sold or distributed by Recyclebank or through any Website will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to these Terms.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Conditions of Use as a court would.
To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our Legal Department, RecycleRewards, Inc., 151 W. 26th Street, 11th Floor, New York, NY 1001. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. We will reimburse those fees for claims totaling less than $10,000 unless the arbitrator determines the claims are frivolous. Likewise, Recyclebank will not seek attorneys' fees and costs in arbitration unless the arbitrator determines the claims are frivolous. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.
We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.
NOTICE AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT
It is our policy to respond appropriately to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (“DMCA”), including by removing or disabling access to material claimed to be the subject of infringing activity. You should send any claims or notices of infringement relating to the Site or any of its contents to Recyclebank’s designated Copyright Agent.

EXTRAORDINARY EVENTS/TECHNICAL DIFFICULTIES
You specifically agree to hold Recyclebank harmless from any and all claims, and agree that Recyclebank shall not be liable for any loss, actual or perceived, caused directly or indirectly by government regulation, exchange or market regulation, suspension of trading, war, strike, equipment failure, communication line failure, system failure, security failure on the Internet, unauthorized access, theft or any problem, technological or otherwise, that might prevent you from entering or Recyclebank from executing an order, or other conditions beyond our control. Furthermore, in a technical environment, should an error occur with respect to the tracking of any order or order entry, the true, actual and correct transaction or position will be restored.
